The AGENT certifies that he is currently licensed to practice before the United States Patent and Trademark Office as a registered patent agent in good standing, and is thereby authorized to perform U.S. patent application services. The AGENT registration number is 35259.

The INVENTOR first disclosed PROPRIETARY MATERIALS describing the invention to the AGENT on the dates(s) indicated by the AGENT on the attached description. The AGENT will receive and utilize these PROPRIETARY MATERIALS under the following conditions:

The AGENT shall use these PROPRIETARY MATERIALS, and the information disclosed therein, solely for purposes requested by the INVENTOR.

The AGENT agrees not to disclose these PROPRIETARY MATERIALS, or the information disclosed therein to anyone except as authorized by the INVENTOR. The INVENTOR hereby grants to the AGENT the authority to disclose these PROPRIETARY MATERIALS to a patent search firm chosen by the AGENT. The AGENT shall return all PROPRIETARY MATERIALS, and copies thereof, to the INVENTOR at any time as requested by the INVENTOR.

The non-disclosure terms defined herein shall not apply to any information that the AGENT has determined becomes part of the general public knowledge through no fault of the AGENT, or after publication by a patent office disclosing the PROPRIETARY MATERIALS.

If a search is requested by the INVENTOR, the AGENT agrees to complete a U.S. PATENT SEARCH on the above invention within four weeks of receipt by the AGENT of an invention disclosure and the agreed upon search fee. The search will be conducted by the AGENT or a search firm selected by the AGENT. The search will include U.S. Patents back to 1790 (year). The AGENT will provide to the INVENTOR a search report and an opinion on patentability and a copy of each of the most relevant prior art patents. The search firm fees may differ from the AGENT search fees.

This search will not cover pending patents that have not yet been published, because these are not available for searching. It also does not cover foreign patents and non-patent publications such as newspaper and magazine articles.

The AGENT does not guarantee the search to be complete or comprehensive, because the art of patent searching is inherently complex. More than ten million U.S. patents have issued to date. The AGENT uses the best quality search methods and search firms known to the AGENT. However, the AGENT cannot completely verify the search firm’s results.

This agreement applies only to the invention named herein and disclosed in the accompanying documents and materials. By using the services of the AGENT, you consent to use by the AGENT of your PROPRIETARY MATERIALS and information as described in the TERMS OF SERVICE herein.
